Request for Release from Covenant of SD #00-03, Steven-Heyliger, Old Hay Road Assessor
Mr. Heyliger asked the Board to accept money in escrow to construct the guardrail in return for a complete release of the subdivision lots.  Mr. Heyliger presented an estimate for the guardrail (material and labor) for $2,400.  Mr. Parent made a suggestion to double the 2 x 8

Mr. Peterson questioned whether or not the plan, as submitted, was a subdivision.  He said that the plan did not meet most of the requirements in the Subdivision Rules and Regulations, and that the applicant was requesting waivers from most of the requirements, including construction of the road.  Mr. Peterson advised the board to not consider the plan on the basis of zoning (whether or not the lots were merged for zoning purposes), but on the basis that it does not meet the requirements of the Subdivision Rules and Regulations.  He also questioned if a modification is

required to the original 1985 subdivision that created the lot to change its shape and area.  Mr. Peterson told the board that they have 60 days to act on the plan, and he recommended seeking an opinion from Town Counsel as to whether it is a subdivision.
